Patient data protection

Our programme depends on patient samples, genomic data and clinical records. PranAmritam Pvt. Ltd. treats that information as a trust. These healthcare-specific confidentiality terms (Clause 7.5) sit on top of the general confidentiality provisions in Clauses 7.1 to 7.4 and bind every party to the Project as fully as a standalone non-disclosure agreement.

  • Clause 7.5(a)

    What we treat as Protected Health Information

    Any individually identifiable health information about a patient or research participant, in any form. This includes clinical, demographic, genomic, single-cell and sequencing data, pathology and imaging data, sample identifiers and linkage codes, and anything derived from them that could reasonably identify a person.

  • Clause 7.5(b)

    Used only for the Project, within consent

    PHI is accessed, used and disclosed only for the Project and only as far as each patient's informed consent and the ethics approvals allow. It is never used for insurance, employment, credit or any other eligibility decision.

  • Clause 7.5(c)

    No re-identification

    No party may re-identify, or help anyone else re-identify, de-identified or pseudonymised data or samples. If a patient is identified by accident, the other party is told within five business days and the information is secured again straight away.

  • Clause 7.5(d)

    Minimum-necessary access

    Only personnel, contractors and advisors who need PHI for the Project can access it, including clinical staff, laboratory personnel and genetic counsellors. Each is bound in writing by confidentiality terms at least as protective as Clause 7.5.

  • Clause 7.5(e)

    Administrative, technical and physical safeguards

    PHI is encrypted in transit and at rest. Access is role-based and audit-logged, and data sits in secure, segregated environments, in line with the HIPAA Security Rule (USA) and the Digital Personal Data Protection Act, 2023 (India).
